Respirico Terms and Conditions of Sale

These Terms and Conditions apply to all purchases made on the Respirico website, by phone, in person, or through any Respirico representative. By placing an order, you agree to be bound by these Terms.

1. Website Use and Ordering

By using www.respirico.com.au you accept these Terms. Respirico may update these Terms at any time. Continued use of the Website confirms your acceptance of any changes.

To place an order, you must be at least eighteen (18) years of age and legally able to enter a contract. All information provided when placing an order must be accurate.

Products displayed on the Website are an invitation to purchase. Respirico may accept or decline an order at its discretion.

2. Product Information

Respirico aims to provide accurate product descriptions, images, and specifications. Minor variations may occur between products and descriptions. Accessories shown in images are not included unless stated.

Respirico may correct any information errors on the Website at any time.

3. Pricing and Payments

All prices are listed in Australian dollars and include GST where applicable. Shipping, delivery, handling, and installation may incur additional charges.

Full payment is required before products are dispatched. Payments may be processed through Respirico’s payment methods or approved third parties.

Respirico is not responsible for losses arising from fraudulent or unauthorised card use where permitted under Australian law.

4. Pricing Errors

Despite best efforts, pricing errors may occur. This includes cases where an incorrect price would cause Respirico to incur a loss.

If a pricing error is identified, the following applies.

If the correct price is higher than the displayed price, Respirico may contact you to confirm whether you wish to proceed at the correct price. If you do not agree, the order will be cancelled and refunded.

If the correct price is lower than the displayed price, Respirico will charge the lower price and fulfil the order.

If the incorrect price results in a financial loss to Respirico, Respirico reserves the right to cancel the order and issue a full refund.

5. Funded Purchases (NDIS, My Aged Care and Other Funding Bodies)

Respirico accepts orders funded through the National Disability Insurance Scheme (NDIS), My Aged Care, and other government or third-party funding organisations where applicable. This includes purchases made by participants, nominees, plan managers, funding administrators, or relevant agencies.

All funded purchases must comply with the applicable legislation, pricing arrangements, guidelines, and eligibility requirements of the relevant funding body.

Orders may be cancelled if funding cannot be confirmed, required documentation is incomplete, or the product does not meet the criteria or category requirements of the funding organisation.

Respirico follows applicable invoicing, compliance, and audit standards required by each funding body.

6. Order Cancellation

Respirico may cancel an order if products become unavailable, payment cannot be verified, fraudulent activity is suspected, pricing errors occur, or NDIS funding cannot be validated.

If an order is cancelled before dispatch, a refund will be issued. Merchant fees may be deducted where applicable.

Orders cannot be cancelled by you once dispatched, unless a right to do so exists under consumer law.

7. Delivery

Delivery timeframes are estimates. Respirico is not liable for delays caused by couriers, suppliers, customs, or external factors.

Certain products may require extended lead times due to manufacturing or supply limitations.

A signature may be required unless you authorise unattended delivery. If you choose unattended delivery, included insurance may be void.

Risk transfers to you when goods are delivered or collected.

8. Faulty Goods and Consumer Guarantees

All Respirico products come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a repair, replacement, or refund if the goods are faulty, unsafe, not of acceptable quality, or do not match the description.

If goods arrive damaged, contact Respirico as soon as possible.

9. Privacy

Respirico complies with the Privacy Act 1988. Personal information may be used to process orders, liaise with NDIS providers, arrange delivery, and offer support.

Information may be shared with third parties where required to fulfil your order or comply with legal obligations.

10. Liability

To the extent permitted by law, Respirico is not responsible for delays, losses caused by incorrect information provided by you, or indirect or consequential losses.

Nothing in these Terms removes your rights under the Australian Consumer Law.

11. Force Majeure

Respirico is not responsible for delays or failure to perform obligations due to events outside its control, including natural disasters, supply chain disruptions, industrial actions, or government restrictions.

12. Governing Law

These Terms and Conditions are governed by the laws of South Australia. Any disputes will be resolved in the courts of South Australia.
